Family law in the UK encompasses a comprehensive legal framework governing various aspects of familial relationships. It addresses matters such as marriage, divorce, child custody, adoption, domestic violence, and financial settlements. Under family law, procedures and regulations are established for formalizing marriages and civil partnerships, as well as for the dissolution of these unions through divorce or separation. Courts aim to prioritize the best interests of children in custody and access arrangements, while also ensuring appropriate financial support through child maintenance payments. Legal protections are provided for victims of domestic violence through non-molestation orders and occupation orders.

Additionally, family law addresses issues related to cohabitation, property rights, surrogacy, and international aspects such as child abduction and jurisdictional disputes. These laws are primarily governed by statutes like the Family Law Act 1996, the Matrimonial Causes Act 1973, and the Children Act 1989, alongside case law and legal precedents that shape interpretations and applications of these statutes.

Family Law Act

The Family Law Act 1996 (c 27) is an Act of Parliament of the United Kingdom governing divorce law and marriage. The law intends to modernise divorce and to shift slightly towards “no fault” divorce from the fault-based approach of the Matrimonial Causes Act 1973.

Islamic Divorce

you are legally married and you want to get divorced you can apply for a no-fault divorce. If your wedding was a Nikah under Sharia law and it took place in England without a civil marriage then you won’t need to apply for a no-fault divorce as you are not treated in English law as legally married
‘Jurisprudence. The term talaq is commonly translated as “repudiation” or simply “divorce”. In classical Islamic law it refers to the husband’s right to dissolve the marriage by simply announcing to his wife that he repudiates her’

Child Custody

Each Child Arrangements Order is decided on the circumstances of the individual family and on what is in the best interests of that particular child. This means that there is no such thing as a ‘usual’ arrangement. Child Arrangements Orders are governed by section 8 of the Children Act 1989.

That said, experts in the field tend to categorize all of these different arrangements into three fundamental co-parenting models:
  • Parallel parenting.
  • Cooperative co-parenting.
  • Conflicted co-parenting.

Domestic Abuse

The Domestic Abuse Act 2021 strives to achieve three distinct things: Raise awareness of domestic abuse, and the impact it can have. Increase efficiency in protecting victims and addressing abuse. Provide better support for victims of domestic abuse across the UK

Many kinds of domestic abuse are criminal offences and the police can arrest, caution or charge the perpetrator. Most police stations have Domestic Violence Units or Community Safety Units with specially trained officers to deal with domestic violence and abuse.
